DSCR Navigator Terms of Use
Effective Date: September 25, 2026
These Terms of Use (“Terms”) govern your access to and use of the DSCR Navigator website, software, applications, databases, tools, reports, presentations, lender information, and related services (collectively, the “Service”).
The Service is operated by Mortgage Broker Navigator LLC, doing business as DSCR Navigator (“DSCR Navigator,” “Mortgage Broker Navigator,” “Company,” “we,” “us,” or “our”).
By creating an account, purchasing or beginning a subscription or free trial, accessing the Service, or otherwise using DSCR Navigator, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy, available at: https://dscrnavigator.com/privacy
If you are using the Service on behalf of a company, mortgage brokerage, lender, or other organization, you represent that you have authority to bind that organization to these Terms.
If you do not agree to these Terms, you may not access or use the Service.
1. Description of the Service
DSCR Navigator is a software platform designed primarily for mortgage professionals to research, compare, analyze, and present information regarding Debt Service Coverage Ratio (“DSCR”) and other mortgage loan programs.
The Service may include, among other things:
- lender and investor guideline information;
- eligibility searches;
- loan scenario analysis;
- program comparisons;
- lender filtering and ranking;
- pricing or rate information;
- automated calculations;
- guideline summaries and source language;
- eligibility, near-miss, and ineligibility explanations;
- client or borrower presentations;
- lender and Account Executive profiles;
- ratings and reviews;
- reports and analytics;
- automated or artificial-intelligence-assisted functionality; and
- other mortgage-related information and tools.
Features may be added, removed, modified, or discontinued from time to time.
2. DSCR Navigator Is a Software Tool, Not a Lender or Credit Decision Maker
DSCR Navigator is a technology and information service.
Unless expressly stated otherwise, DSCR Navigator is not acting as a mortgage lender, creditor, underwriter, loan servicer, appraiser, attorney, accountant, financial adviser, or other professional adviser through operation of the Service.
A result displayed as “eligible,” “approved,” “qualified,” “near miss,” “ineligible,” “declined,” or similar terminology reflects the Service’s application of available lender information to the information entered by the user. It does not constitute:
- a loan approval;
- an underwriting decision;
- a commitment to lend;
- a rate lock;
- a credit decision;
- a guarantee of eligibility;
- a guarantee that a lender will accept or fund a loan; or
- a representation made on behalf of any lender.
Only the applicable lender or creditor can make a final credit, underwriting, pricing, or loan approval decision.
3. Lender Guidelines and Information May Change
Mortgage guidelines, pricing, overlays, loan programs, underwriting interpretations, state restrictions, prepayment penalty rules, reserve requirements, loan-to-value limits, credit requirements, and other lending criteria may change frequently and without notice.
DSCR Navigator attempts to maintain accurate and useful information, but we do not guarantee that every lender guideline, rule, rate, calculation, source document, summary, or program description is complete, current, or error-free.
Users remain responsible for verifying material loan requirements directly with the applicable lender before relying on information from the Service to structure, disclose, submit, lock, or close a loan.
Where DSCR Navigator displays source guideline language, the source material should be reviewed when necessary.
If there is a conflict between information displayed by DSCR Navigator and the applicable lender’s current official guidelines, the lender’s current official guidelines control.
4. Professional and Regulatory Responsibility
The Service is intended to assist qualified mortgage professionals and is not a substitute for the user’s professional judgment.
You are solely responsible for:
- determining whether you are properly licensed or authorized to conduct your business;
- complying with federal, state, and local mortgage laws and regulations;
- satisfying advertising, disclosure, licensing, privacy, fair lending, recordkeeping, and other regulatory requirements;
- determining whether a loan or loan feature is lawful in the applicable jurisdiction;
- properly communicating loan terms to borrowers;
- verifying lender requirements; and
- obtaining any approvals or disclosures required for a transaction.
DSCR Navigator does not provide legal, tax, accounting, compliance, investment, or financial advice.
5. Account Registration
Certain portions of the Service require an account.
You agree to provide accurate, complete, and current information when registering and to keep your account information updated.
You may not:
- impersonate another person or organization;
- create an account using false information;
- create an account for the purpose of bypassing a suspension or termination;
- allow unauthorized persons to use your account; or
- create multiple accounts to circumvent subscription limits, security restrictions, or other Service controls.
We may require verification of your identity, company affiliation, email address, mobile telephone number, or other account information.
6. Account Security
You are responsible for safeguarding your login credentials and authentication methods.
You must:
- use a strong and unique password;
- maintain control of any multifactor authentication method associated with your account;
- protect authentication codes, recovery codes, and access tokens;
- promptly notify us of suspected unauthorized access; and
- log out of accounts on shared or untrusted devices.
You may not knowingly share your credentials with another person unless your subscription expressly allows shared or multi-user access.
You are responsible for activity occurring through your account to the extent permitted by law.
We may suspend or restrict an account when we reasonably believe the account has been compromised or is being used in violation of these Terms.
7. Limited License
Subject to these Terms and payment of applicable fees, DSCR Navigator grants you a limited, revocable, non-exclusive, non-transferable, non-sublicensable license to access and use the Service for legitimate business purposes related to mortgage origination, loan analysis, lender research, and related professional activities.
This license does not transfer ownership of the Service, database, software, methodology, or content to you.
You may generate, download, print, and share individual borrower or client presentations produced through normal use of DSCR Navigator.
You may not use this permission to systematically reproduce or redistribute DSCR Navigator’s lender database, guideline library, underlying data, or program information.
8. Intellectual Property
Except for content owned by lenders or other third parties, DSCR Navigator and its licensors own all rights, title, and interest in and to the Service, including its:
- software;
- source code and object code;
- database structure;
- lender database compilation;
- taxonomy;
- organization of guideline information;
- normalized guideline data;
- search methodologies;
- ranking methodologies;
- eligibility logic;
- scoring systems;
- algorithms;
- prompts;
- workflows;
- interfaces;
- designs;
- text;
- graphics;
- reports;
- analytics;
- presentations;
- proprietary annotations;
- summaries; and
- other intellectual property.
The selection, coordination, organization, normalization, and compilation of information within DSCR Navigator constitute valuable proprietary assets regardless of whether portions of the underlying source material are publicly available or owned by third parties.
No rights are granted except those expressly stated in these Terms.
9. Strictly Prohibited Data Extraction and Competitive Use
You may not, directly or indirectly, manually or through automated means:
- scrape, crawl, spider, harvest, copy, download, capture, extract, or systematically collect information from the Service;
- perform bulk extraction of lender guidelines, loan programs, eligibility criteria, pricing information, source citations, database records, or other Service data;
- use bots, scripts, browser automation, robotic process automation, APIs not expressly authorized by us, headless browsers, automated agents, or similar technologies to access the Service;
- reconstruct, replicate, mirror, or create a substantially similar copy of the DSCR Navigator database;
- use information obtained from DSCR Navigator to create, train, improve, validate, benchmark, or operate a competing mortgage guideline database, search engine, artificial intelligence system, machine-learning model, software product, or commercial service;
- submit DSCR Navigator content, outputs, lender data, guideline data, or proprietary information to an artificial intelligence or machine-learning system for the purpose of reproducing or building a competing database, product, or service;
- sell, license, sublicense, publish, distribute, commercially redistribute, or provide bulk access to DSCR Navigator data;
- use multiple accounts or coordinated users to evade technical limits intended to prevent bulk extraction;
- remove copyright, trademark, source attribution, watermark, ownership, confidentiality, or proprietary notices;
- circumvent rate limits, access controls, subscription restrictions, authentication systems, or other technological protections; or
- assist another person or organization in performing any of these activities.
Normal searches performed by a mortgage professional for individual loan scenarios are expressly permitted.
10. Unauthorized Access and Security Activities
You may not attempt to gain unauthorized access to the Service or any related system, network, account, database, server, cloud environment, administrative interface, API, source code repository, storage system, or infrastructure.
Without our prior written authorization, you may not:
- probe or scan the Service for vulnerabilities;
- conduct penetration testing;
- attempt credential stuffing or password attacks;
- intercept traffic;
- bypass authentication;
- defeat multifactor authentication;
- exploit vulnerabilities;
- introduce malicious code;
- upload malware;
- perform denial-of-service attacks;
- intentionally generate excessive traffic;
- manipulate API requests;
- access another user’s data;
- escalate account privileges;
- attempt SQL injection, cross-site scripting, command injection, or similar attacks;
- attempt to identify or extract encryption keys, credentials, tokens, or secrets;
- reverse engineer security mechanisms; or
- encourage another person to do so.
Good-faith security researchers must obtain written permission before testing the Service.

11. Reverse Engineering
Except where a restriction is prohibited by applicable law, you may not:
- reverse engineer;
- decompile;
- disassemble;
- decode;
- translate;
- derive source code from;
- analyze internal algorithms of; or
- otherwise attempt to discover the underlying structure, logic, methodology, source code, prompts, models, database design, or proprietary processes of the Service.
12. Misuse of Data
You may access information through DSCR Navigator only for legitimate purposes associated with your authorized use of the Service.
You may not use data obtained through the Service for:
- identity theft;
- fraud;
- phishing;
- credential theft;
- unauthorized solicitation;
- unlawful discrimination;
- unauthorized marketing;
- unlawful surveillance;
- harassment;
- competitive intelligence obtained through prohibited extraction;
- resale of data; or
- any illegal activity.
Suspected criminal activity may be preserved, investigated, and reported to appropriate authorities as permitted or required by law.
13. Protection of Borrower and Consumer Information
Users should enter only information reasonably necessary to analyze the applicable loan scenario.
Unless DSCR Navigator expressly provides a feature designed to securely receive such information, you must not enter or upload:
- Social Security numbers;
- complete tax identification numbers;
- bank account or routing numbers;
- passwords;
- online banking credentials;
- authentication codes;
- unredacted government identification documents;
- complete credit reports;
- payment card information outside an authorized payment interface; or
- other highly sensitive information that is unnecessary for operation of the Service.
Users who enter information relating to borrowers, applicants, customers, employees, or other individuals represent that they have the legal right and appropriate authorization to provide that information.
Mortgage professionals remain responsible for their obligations concerning nonpublic personal information and consumer data under applicable privacy and information-security laws.
14. User Content
You may be permitted to submit reviews, lender information, guideline corrections, comments, files, feedback, scenario information, or other material (“User Content”).
You retain ownership of User Content that you own.
You grant DSCR Navigator a non-exclusive, worldwide, royalty-free license to host, store, process, reproduce, modify, analyze, and display User Content as reasonably necessary to operate, maintain, secure, improve, and provide the Service.
You represent that you have the necessary rights to provide any User Content you submit.
You may not knowingly submit false, defamatory, unlawful, infringing, fraudulent, or malicious content.
15. Account Executive and Lender-Submitted Information
Certain lenders, Account Executives, or authorized representatives may be permitted to manage or provide information concerning their companies or loan programs.
Submitting information does not guarantee that DSCR Navigator will publish, accept, or rely upon that information.
DSCR Navigator may review, verify, edit, reconcile, reject, or remove submitted information.
Users submitting lender or program information represent that:
- they are authorized to submit the information;
- the information is accurate to the best of their knowledge; and
- their submission does not violate another party’s intellectual property or confidentiality rights.
16. Feedback
If you provide suggestions, ideas, feature requests, error reports, recommendations, or other feedback concerning DSCR Navigator, you grant us the unrestricted right to use that feedback to operate, modify, develop, and improve the Service without compensation or obligation to you.
This provision does not give us ownership of confidential borrower information contained in a support request.
17. SMS and Text Messaging Terms
A. DSCR Navigator Messaging Program
By providing your mobile telephone number and expressly opting in to a DSCR Navigator text messaging program, you agree that Mortgage Broker Navigator LLC, doing business as DSCR Navigator, may send SMS or MMS messages to that number for the purposes disclosed when you provide your consent.
Depending upon the program you select, messages may include:
- account verification or security messages;
- authentication or login notices;
- account activity alerts;
- customer support communications;
- subscription or billing notifications;
- product or service notifications;
- requested reminders or alerts; and
- marketing or promotional messages if you have separately consented to receive them.
Consent for one type of message does not automatically constitute consent for unrelated promotional messages.
Where legally required, promotional or marketing messages will be sent only after obtaining the applicable consent.
B. Consent
By opting in, you represent that:
- you are the subscriber or authorized user of the mobile number provided;
- you authorize Mortgage Broker Navigator LLC and DSCR Navigator to send the messages described in the applicable opt-in disclosure; and
- your consent applies only to DSCR Navigator and the messaging purposes disclosed to you.
Consent to receive promotional text messages is not a condition of purchasing DSCR Navigator services unless expressly permitted by applicable law for a particular service.
Consent may not be transferred from another company to DSCR Navigator.
C. Automated Messaging
Some messages may be transmitted using an automatic telephone dialing system, automated messaging system, or similar technology.
D. Message Frequency
Message frequency varies based upon your account activity, requests, and the messaging programs to which you subscribe.
E. Message and Data Charges
Message and data rates may apply.
Your wireless carrier may charge you for sending or receiving SMS or MMS messages according to the terms of your wireless service plan.
F. How to Opt Out
You may opt out of a text messaging program at any time by replying STOP to a DSCR Navigator message.
We may send one final message confirming that your opt-out request has been processed.
After opting out, you will no longer receive messages from the applicable messaging program unless you subsequently provide valid consent to opt in again.
We will also honor other legally recognized requests to revoke consent where required.
Opting out of security or account-related text messages may prevent you from using features that require SMS communication.

H. Delivery
Wireless carriers and telecommunications providers do not guarantee message delivery.
Carriers are not liable for delayed or undelivered messages.
Message delivery may be affected by your device, wireless service, network availability, carrier filtering, geographic location, or other circumstances outside our control.
I. Mobile Number Changes
You agree to notify us if you discontinue or transfer a mobile telephone number associated with your account so that messages are not inadvertently sent to another person.
J. Mobile Data and SMS Consent
We do not sell or share your SMS opt-in data or personal information with third parties or affiliates for their marketing or promotional purposes.
Mobile telephone numbers, SMS consent records, and opt-in information will not be sold, rented, or transferred to another business for that business’s independent marketing campaign.
Information may be provided to vendors and service providers, including messaging and telecommunications providers, solely as necessary to provide and support our messaging services, subject to appropriate contractual and legal restrictions.

18. Subscription, Billing, and Automatic Renewal
Certain features require a paid subscription.
Prices, billing periods, included features, and other subscription terms will be disclosed at or before checkout.
Unless otherwise stated at checkout, subscriptions automatically renew for successive billing periods until canceled.
By purchasing a recurring subscription, you authorize us and our payment processor to charge the payment method associated with your account for applicable subscription fees, taxes, and authorized charges.
You may cancel a subscription through the available subscription or billing portal or other cancellation method we provide.
Cancellation ordinarily prevents future renewal charges but does not retroactively cancel charges already incurred.
Except where required by law or expressly stated otherwise, subscription payments are non-refundable once charged.
We may change subscription pricing prospectively. When required by applicable law, we will provide advance notice before the new price applies.
19. Free Trials and Promotional Offers
DSCR Navigator may offer free trials, promotional periods, coupons, discounts, or other offers.
The specific terms displayed with the promotion control.
Unless expressly stated otherwise, if a free trial requires a payment method and converts to a paid subscription, your subscription will automatically begin at the end of the trial period unless you cancel before the trial expires.
Promotional offers may be limited to eligible users and may not be combined, transferred, sold, duplicated, or abused.
We may revoke a promotional benefit obtained through fraud or misuse.
20. Payment Processing
Payment processing may be provided by third-party payment processors such as Stripe.
Your payment information may be provided directly to the payment processor and may be subject to that provider’s terms and privacy practices.
DSCR Navigator may not directly receive or store your complete payment card number.
21. Third-Party Services
The Service may integrate with or link to third-party services, lenders, websites, APIs, payment processors, data providers, or other software.
We do not control third-party services and are not responsible for their availability, security, content, policies, or actions.
Your use of third-party services may be governed by separate terms.
22. Suspension and Termination
We may suspend, restrict, or terminate access to the Service when we reasonably believe that:
- these Terms have been violated;
- an account has been compromised;
- fraudulent or illegal activity has occurred;
- automated scraping or bulk extraction is occurring;
- an account is being used to attack or interfere with the Service;
- payment obligations have not been satisfied;
- continued access creates a security or legal risk; or
- suspension is necessary to protect DSCR Navigator, its users, lenders, or third parties.
Where appropriate, we may investigate suspected violations before restoring access.
You may discontinue use of the Service at any time, subject to applicable subscription and billing obligations.
23. Investigation and Preservation of Evidence
If we reasonably suspect unauthorized access, data theft, scraping, infringement, fraud, attacks against the Service, or another material violation of these Terms, we may preserve relevant records and investigate the activity.
To the extent permitted by law, such records may include:
- login records;
- IP address information;
- browser and device information;
- authentication events;
- access logs;
- API requests;
- searches;
- downloads;
- account activity;
- security alerts; and
- other relevant technical information.
We may cooperate with law enforcement, courts, regulators, cybersecurity providers, internet service providers, hosting providers, or other appropriate parties when legally authorized or required to do so.
24. Remedies for Data Theft and Intellectual Property Violations
You acknowledge that unauthorized scraping, extraction, redistribution, reverse engineering, disclosure, or misuse of DSCR Navigator’s proprietary data may cause harm that cannot be adequately remedied solely through monetary damages.
Accordingly, to the fullest extent permitted by law, DSCR Navigator may seek temporary, preliminary, and permanent injunctive relief or other equitable remedies to stop actual or threatened unauthorized access, extraction, disclosure, or use without first being required to establish that monetary damages alone are inadequate.
These remedies are in addition to any other legal remedies available to us.
Nothing in these Terms limits our ability to pursue claims arising from unauthorized access, violations of applicable computer crime laws, intellectual property infringement, theft of trade secrets, fraud, breach of contract, or other unlawful conduct.
25. Security Measures
We may employ administrative, technical, and organizational safeguards intended to protect the Service and information processed through it.
Such safeguards may include authentication controls, multifactor authentication, encryption, monitoring, access restrictions, logging, network security controls, rate limiting, backups, vulnerability management, and similar measures as appropriate.
However, no website, database, network, or information system can be guaranteed to be completely secure.
You acknowledge that use of internet-based services involves inherent cybersecurity risks.
DSCR Navigator does not warrant that unauthorized third parties will never defeat security measures or improperly access information.
26. Availability of the Service
We strive to provide reliable Service but do not guarantee uninterrupted or error-free operation.
The Service may occasionally become unavailable because of:
- scheduled maintenance;
- software updates;
- internet outages;
- hosting provider outages;
- cyberattacks;
- third-party service failures;
- telecommunications failures;
- emergencies; or
- other circumstances.
We may modify or discontinue features as the Service evolves.
27. Disclaimer of Warranties
TO THE FULLEST EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS.
DSCR NAVIGATOR DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AVAILABILITY, AND FITNESS OF INFORMATION FOR A PARTICULAR LOAN TRANSACTION.
WE DO NOT WARRANT THAT:
- THE SERVICE WILL BE ERROR-FREE;
- ALL LENDER INFORMATION WILL ALWAYS BE CURRENT;
- EVERY ELIGIBILITY RESULT WILL MATCH A LENDER’S UNDERWRITING DECISION;
- EVERY CALCULATION WILL BE ERROR-FREE;
- THE SERVICE WILL BE AVAILABLE AT ALL TIMES; OR
- THE SERVICE WILL BE COMPLETELY FREE FROM SECURITY VULNERABILITIES.
YOU ARE RESPONSIBLE FOR INDEPENDENTLY VERIFYING INFORMATION THAT IS MATERIAL TO A LOAN TRANSACTION.
28. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, DSCR NAVIGATOR, MORTGAGE BROKER NAVIGATOR LLC, AND THEIR OWNERS, OFFICERS, EMPLOYEES, CONTRACTORS, AFFILIATES, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, LOST REVENUE, LOST BUSINESS, LOSS OF DATA, LOSS OF GOODWILL, OR LOSS OF BUSINESS OPPORTUNITY ARISING FROM OR RELATING TO THE SERVICE.
THIS INCLUDES LOSSES ARISING FROM:
- RELIANCE UPON LENDER INFORMATION;
- CHANGES IN LENDER GUIDELINES;
- LOAN DENIALS;
- PRICING CHANGES;
- MISSED LOCKS;
- FAILED TRANSACTIONS;
- SERVICE INTERRUPTIONS;
- THIRD-PARTY SERVICES;
- SECURITY INCIDENTS; OR
- UNAUTHORIZED ACCESS THAT OCCURS DESPITE REASONABLE SECURITY MEASURES.
TO THE FULLEST EXTENT PERMITTED BY LAW, OUR TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS WILL NOT EXCEED THE GREATER OF:
- THE AMOUNT YOU PAID TO DSCR NAVIGATOR DURING THE TWELVE MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM; OR
- ONE HUNDRED DOLLARS ($100).
Some jurisdictions do not permit certain limitations of liability, so portions of this section may not apply to you.
29. Indemnification
To the fullest extent permitted by law, you agree to defend, indemnify, and hold harmless Mortgage Broker Navigator LLC, DSCR Navigator, and their owners, officers, employees, contractors, affiliates, and service providers from claims, damages, losses, liabilities, penalties, costs, and reasonable attorneys’ fees arising from or relating to:
- your violation of these Terms;
- your unlawful use of the Service;
- information or content you submit;
- your violation of another person’s intellectual property or privacy rights;
- your failure to comply with applicable mortgage or consumer protection requirements; or
- your fraudulent, malicious, or unauthorized activity.
30. Trademarks and Third-Party Materials
DSCR Navigator and related logos, branding, product names, and design elements are trademarks or other intellectual property of Mortgage Broker Navigator LLC or its licensors.
Lender names, logos, trademarks, loan program names, and lender-authored documents remain the property of their respective owners.
The appearance of a lender or program within DSCR Navigator does not necessarily mean that the lender sponsors, endorses, or is affiliated with DSCR Navigator unless expressly stated.
31. Confidential and Proprietary Information
Nonpublic information concerning DSCR Navigator’s software, databases, algorithms, business processes, internal operations, security architecture, pricing arrangements, proprietary lender normalization methodology, or unpublished features is confidential and proprietary.
You may not disclose or use such information except as necessary for authorized use of the Service.
Information intentionally made publicly available by DSCR Navigator is not confidential solely because it was obtained through the Service.
32. Changes to These Terms
We may modify these Terms from time to time.
When changes are material, we may provide notice through the Service, by email, or by another reasonable method.
The revised Terms will become effective on the date stated in the updated Terms, subject to any additional notice or consent required by law.
Continued use of the Service after the effective date of revised Terms constitutes acceptance of the revised Terms to the extent permitted by law.
33. Governing Law
These Terms and disputes arising from them will be governed by the laws of the State of Missouri, without regard to conflict-of-law principles, except where federal law controls or applicable law requires otherwise.
34. Dispute Resolution and Arbitration
PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS.
Except for disputes eligible for small claims court and claims seeking temporary or injunctive relief relating to unauthorized access, cybersecurity attacks, data theft, intellectual property, confidential information, or misuse of the Service, any dispute arising out of or relating to these Terms or the Service will, to the fullest extent permitted by law, be resolved through binding individual arbitration rather than a jury trial.
Arbitration will be administered by the American Arbitration Association (“AAA”) under the rules applicable to the dispute.
Unless the parties agree otherwise, arbitration will occur in Missouri or remotely by telephone or videoconference when permitted by the applicable rules.
Nothing in this section prevents Mortgage Broker Navigator LLC or DSCR Navigator from seeking immediate equitable or injunctive relief in a court of competent jurisdiction to prevent or stop unauthorized access, scraping, data extraction, intellectual property infringement, cybersecurity attacks, or misuse of proprietary information.
Class Action Waiver
TO THE FULLEST EXTENT PERMITTED BY LAW, DISPUTES MUST BE BROUGHT ON AN INDIVIDUAL BASIS.
NEITHER PARTY MAY PARTICIPATE AS A PLAINTIFF OR CLASS MEMBER IN A CLASS, CONSOLIDATED, COLLECTIVE, OR REPRESENTATIVE ACTION OR ARBITRATION.
If applicable law prevents enforcement of this waiver for a particular claim, that claim will proceed as required by applicable law.
35. No Waiver
Failure to enforce a provision of these Terms does not constitute a waiver of that provision or any other right.
36. Severability
If a provision of these Terms is determined to be invalid or unenforceable, that provision will be enforced to the maximum extent permitted, and the remaining provisions will continue in effect.
37. Assignment
You may not assign or transfer your rights under these Terms without our prior written consent.
Mortgage Broker Navigator LLC may assign these Terms in connection with a merger, acquisition, corporate reorganization, sale of assets, financing transaction, or similar business transaction.
38. Entire Agreement
These Terms, together with the Privacy Policy, applicable subscription terms, and other policies expressly incorporated by reference, constitute the agreement between you and Mortgage Broker Navigator LLC concerning the Service.
